Acceptance and Modification of Agreement

ZUKCLOUD reserves the right to modify these Agreement terms at any time, unilaterally. Modifications take effect immediately upon publication on the website. We have no obligation to send you separate individual notice of changes.

You are responsible for reviewing this page regularly. Continued use of any ZUKCLOUD service after modifications constitutes your full acceptance of all changes. If you disagree with the modified terms, your sole remedy is to immediately stop using the Service and deactivate your account.

Service Provision and Ownership

We grant you a limited, non-transferable, non-exclusive right to remotely access via network the physical Mac node assigned to you. This does not constitute a sale of any hardware. Ownership of all physical machines, storage media, and network interfaces assigned to you remains absolutely with ZUKCLOUD at all times.

ZUKCLOUD retains final authority over interpretation of the Service. We may, without prior notice, adjust the physical location of data centers, change IP address allocation policies, or perform underlying hardware network cutovers at any time.

Fees, Renewals, and Zero-Refund Policy

• Auto-Renewal: For all subscription plans other than "single-day daily rentals," the system will automatically charge your payment method for the next billing period 24 hours before the end of the current cycle. If you do not wish to renew, you must actively execute Release Node in the console before the charge occurs.
• Pricing Changes: ZUKCLOUD reserves the right to adjust pricing for any plan at any time. New prices will automatically take effect at the start of your next billing cycle.
• Overdue Suspension and Reclaim: If your automatic payment fails, we will immediately hard-cut your node network connection. If payment is not cleared within 24 hours, the node will be immediately subjected to physical erasure and forcibly reclaimed. We bear no responsibility for any data loss resulting from this.

Absolute Data Disclaimer and Backup Responsibility

You fully understand and agree that operating a business on cloud infrastructure carries inherent hardware failure risks.

For any data loss resulting from hardware aging and failure, network interruption, force majeure, or DoD 5220.22-M physical-level data erasure triggered by overdue payment or voluntary node release, ZUKCLOUD bears absolutely no liability of any nature for compensation or remedy.

Hardware Usage Rules and Abuse Definition

To ensure electromechanical stability in our data centers, you may not use rented physical nodes for any of the following activities. ZUKCLOUD holds sole judgment and absolute unilateral discretion over abuse determinations:

• No Cryptocurrency Mining: Use of Apple Silicon compute for any form of cryptocurrency mining (Mining/Farming) is strictly prohibited. Upon discovery, we will immediately and permanently ban your account, confiscate the node, and issue no refund.
• No Network Attacks or Abuse: Initiating DDoS attacks, port scanning, distributing malware, sending spam, or hosting any content that violates local or US federal law is prohibited.
• No Hardware Tampering: Attempting to flash underlying firmware, overclocking, or any action that could cause irreversible physical hardware damage is prohibited. If hardware damage occurs, ZUKCLOUD reserves the right to demand full compensation equal to the original purchase price of the device.

Service Suspension and Unilateral Termination

To protect the platform interests of ZUKCLOUD, we reserve the right, under the following circumstances, to immediately cut off, suspend, or fully terminate your Service without prior notice:

• We unilaterally suspect you have violated any term of this Agreement;
• Required by law enforcement agencies, government departments, or court orders;
• Your node generates abnormal traffic that disrupts the stability of our data center network or other users.

Upon termination of Service, all your console access will be permanently revoked, and we have no obligation to preserve, restore, or transfer any data stored on the machines.

Limitation of Liability and Cap Statement

To the maximum extent permitted by applicable law, ZUKCLOUD and its affiliates, directors, and employees shall not be liable for any indirect, punitive, incidental, special, or consequential damages (including but not limited to loss of profits, loss of business reputation, or data loss), whether arising from breach of contract, tort, or any other cause.

Governing Law and Dispute Jurisdiction

The execution, effectiveness, performance, interpretation, and dispute resolution of this Agreement are governed by the laws of the jurisdiction where the operating entity designated by ZUKCLOUD is located. For any dispute arising from this Agreement, ZUKCLOUD holds the sole right to choose the venue for litigation. As a user, you agree to waive trial by jury and the right to participate in any class action.
